چکیده: کمیسر پارلمانی یکی از نمادهای بارز نهاد آمبودزمان بخش عمومی و حلقه واسط میان دموکراسی و بوروکراسی نوین دولت لیبرال انگلستان است که از طریق رسیدگی به شکایات مردم علیه سوءمدیریت‌های مقام‌ها و نهادهای عمومی از حقوق و آزادی‌های آنان که بر پایه حاکمیت تکثریافته این کشور شکل گرفته‌اند، پاسداری می‌کند. تحولی بنیادین در نظارت بر اداره امور عمومی که علاوه بر تمایز شیوه‌های عمل و اجرا توسط کمیسری و بطور کلی نهاد آمبودزمان نسبت به کارکرد سایر مراجع نظارتی سنتی یعنی دادگاه‌ها و دیوان‌های اداری، موجب شده تا پارلمان از دخالت حداکثری در امور دولت از طریق وضع قانون پرهیز و در مقابل بجای حاکمیت پارلمان بوروکراسی حاکم بر نظام اداری انگلستان به عامل ثبات‌بخش و دفاع از حقوق و آزادی‌های شهروندان تبدیل شود. به همین دلیل این تحقیق که منابع آن به روش کتابخانه-ای گردآوری و مورد بررسی توصیفی – تحلیل قرار گرفته سعی دارد تا نقش با اهمیت کمیسر پارلمانی در تحقق هدف مذکور را از طریق ارایه پاسخی مناسب به این سئوال که: جایگاه و کارکرد کمیسر پارلمانی در نظام حقوقی انگلستان چگونه شکل گرفته و کدام مفهوم حقوقی در تحقق آن نقش کلیدی دارد؟ به بحث گذارد.

Abstract: The parliamentary commissioner is one of the prominent symbols of the public sector ombudsman institution and the middle link between democracy and the bureaucracy of the new liberal government of England, which through handling people’s complaints against the mismanagement of public authorities and institutions of their rights and freedoms based on sovereignty The plural form of this country is guarded. A fundamental evolution in the supervision of public affairs administration, which, in addition to differentiating the methods of action and execution by the commissioner and the ombudsman institution in general, compared to the functioning of other traditional supervisory authorities, i.e. courts and administrative tribunals, has caused the parliament to avoid maximum interference in The affairs of the government should be avoided through the establishment of laws and, instead of the rule of parliament, the bureaucracy governing the British administrative system should become a stabilizing factor and defend the rights and freedoms of citizens. For this reason, this research, the sources of which have been collected in a library method and subjected to a descriptive-analytical analysis, tries to understand the important role of the parliamentary commissioner in realizing the aforementioned goal by providing an appropriate answer to the question: the position and function of the parliamentary commissioner. How was it formed in the English legal system and which legal concept plays a key role in its realization? to discuss
