چکیده: در سیاست تقنینی انگلستان، از زمان پیدایش دولت کارگر جدید در ماه می1970، تمرکز ویژه‌ای بر پیشگیری از بزه‌کاری جوانان شده است. هم قانون جرم و بی‌نظمی مصوب 1998 و هم قانون مهاجرت و عدالت کیفری مصوب 2008 و دیگر قوانین موضوعه انگلستان، پیشگیری از بزه‌کاری اطفال و جوانان را به عنوان هدف اصلی سیاست و مقررات ناظر بر جوانان در نظر گرفته‌اند. هدف این مقاله که به روش تحلیلی ـ توصیفی نگارش شده، بررسی الگوهای پیشگیری حاکم بر سیاست تقنینی انگلستان در نظام عدالت اطفال و جوانان است. ملاحظه قوانین مصوب در این نظام حقوقی و سیاست‌های متخذه در رویه قضایی و احکام صادره، غالباً بر گرایش به تدابیر کیفری و سزادهنده (الگوی پیشگیری واکنشی کیفری) و مداخله در وضعیت‌های مجرمانه کودکان در معرض خطر بزه‌کاری (الگوی پیشگیری کنشی رشدمدار) دلالت دارد و به تدریج از سیاست‌های پیشگیری اولیه، یعنی غیر کیفری و حمایت از کودکان نیازمند، فاصله گرفته است.

Preventing Youth Offending in England Criminal Justice System

Abstract: In England penal policy from the advent of the "New" Labour government in May 1997 signalled an increasing recognition of the determination to prevent youth offending. Both the crime and disorder Act 1998 and the Criminal Justice and Immigration Act 2008 and Other laws, place the prevention of youth offending as the principle aim of youth justice law and policy. The purpose of this paper, which is an analytical-descriptive method, is to examine the patterns of prevention that governs British legal policy in the justice system for children and youth. Considering the laws enacted in this system of law, the mechanisms adopted in the judicial system and the law, often indicate a tendency towards criminal and criminal measures (Criminal Response Model) and intervention in the criminal situations of children at risk of crime (a model of preventive action for growth) and has gradually diverted from early prevention policies, namely non-criminal, and support for needy children.
