چکیده: در نظام حقوق بینالملل تحولات قابل تأملی روی داده که ملاحظات انسانی فصل مشترک بسیاری از آنهاست. ظهور و روند رو به تکامل مفهوم جامعۀ بینالمللی، متضمن شناسایی ارزشهای بنیادین برای این جامعه است، به نحوی که تضمین حمایت و احترام به اصول و ارزشهای مزبور به‌منزلۀ دغدغهای مشترک در نظام بینالمللی مورد توجه است. تاکنون ابزارها و شیوههای مختلفی برای حراست از منافع و ارزشهای مشترک جامعۀ بینالمللی پیش‌بینی شده که هر یک درجهای از مؤثر بودن را دارا هستند؛ اما مؤثرترین اقدام، ضمانت اجرای کیفری و به عبارت دیگر تعقیب، محاکمه و مجازات نقض گستردۀ ارزشهای بنیادین جامعه است. به این ترتیب ایدۀ عدالت کیفری جهانی، به‌منزلۀ یکی از آرمانهای مهم جامعۀ بینالمللی مطرح است که تلاش میشود توسط مراجع قضایی کیفری از جمله دادگاههای بینالمللی و دادگاههای ملی محقق گردد، هر چند هنوز در ابتدای مسیر قرار دارد و تا رسیدن به نقطۀ ایدهآل، بسیار فاصله دارد. در ارزیابی کارآمدی نظام حقوق بینالملل کیفری در جهان معاصر، ناگزیر از توجه به مقتضیات جامعۀ بینالمللی هستیم، همچنان که دغدغۀ جامعۀ بینالمللی برای تحقق عدالت کیفری جهانی و البته موانع پیش روی آن از اهمیت بسزایی برخوردار است.

International community and universal criminal justice

Abstract: There are some important and remarkable developments in the international law common aspect of which is the humanity considerations. The rise of the notion of international community implies fundamental interests and values of the community and this approach is considered as a fundamental goal in the modern world. States and other actors such as international organizations in the international community have proposed and used many different means for protecting these values but some of them aren’t effective and suitable and it seems that the criminal guarantee is needed for the stability of community. Therefore, the rise and development of international criminal law is one of the most important issues in this century and there are some intended and unintended consequences of the rise of international criminal law. So, mutual interaction between international criminal law and international community is true. Some other notions such as international legal order, public order and common good also play notable roles in this relationship and the practice of the International criminal tribunals and national courts is very important.
